Glimsy Refund Policy

This policy sets out the rules for refunding fees paid for paid plans in the Glimsy application. It forms an integral part of the Terms of Use and is to be read together with them and with the Privacy Policy.

The current version is always available at https://glimsy.app/en/refund-policy/ (Polish version: https://glimsy.app/pl/refund-policy/) and from the application settings.

The document is made available in Polish and in English. In the event of any discrepancy, the Polish version prevails. This reservation does not limit any consumer rights arising from mandatory provisions of the law of the consumer's country of habitual residence.

1. Who is the seller and who is the service provider

Payments in Glimsy are handled under the Stripe Managed Payments model, in which the merchant of record is Stripe. Stripe issues the sales document, settles the tax and actually returns the money to the user's payment method.

Glimsy sp. z o.o. is the provider of the service and it is Glimsy that handles reports concerning the operation of the application and decides whether a refund is warranted. Following a positive decision, the refund is executed through Stripe.

A user may submit a refund request by two routes:

  • to Glimsy, at support@glimsy.app — the recommended route, because only Glimsy holds the data needed to assess whether the service actually failed;
  • to Link (Stripe) support, accessible from the receipt or from the Link account.

2. Right of withdrawal (14 days)

A consumer, as well as a trader using the application on consumer terms, has the right to withdraw from a distance contract within 14 days without giving a reason.

Because access to paid features is made available immediately after purchase, before performance begins the user is asked in the application to expressly request that performance begin before the withdrawal period expires and to confirm that they acknowledge the consequences.

The consequences are as follows:

  • The user retains the right of withdrawal within 14 days.
  • On withdrawal they will pay an amount proportionate to the performance rendered up to the moment of withdrawal — that is, for the period of access actually used and for the AI credits used.
  • The right of withdrawal expires once the service has been fully performed, that is, at the end of the paid period.

Withdrawal is notified to support@glimsy.app. No form and no justification are required.

The right under this section is independent of the refund described in section 3 and is available in addition to it.


3. Refund for unavailability of the AI features

3.1. When a refund is available

A refund is available where for technical reasons attributable to Glimsy it was impossible to use the artificial intelligence features — that is, where a request sent to the assistant ended with no response at all as a result of a system failure, a processing timeout, unavailability of the model provider or another infrastructure error.

Glimsy maintains a register of such events linked to the user's account (described in the Privacy Policy). The contents of the register are enumerated in point 3.8 of the Privacy Policy; it contains neither the content of the prompt nor the response. It serves solely to assess a request fairly, in the interest of both parties: it makes it possible to confirm a well-founded claim without requiring the user to prove it.

3.2. When a refund is not available

A refund is not available on the ground of dissatisfaction with the quality, relevance, completeness or correctness of content generated by artificial intelligence.

The AI features are a prototype. The Provider makes every effort to ensure that generated content is of the best possible quality, that the system does not create inappropriate content and that it is resistant to abuse — however, given the nature of language models, it cannot guarantee the correctness or usefulness of any particular response. An inaccurate, incomplete or erroneous response does not constitute unavailability of the service within the meaning of point 3.1.

Nor is a refund available where the absence of a response resulted from: plan limits being exceeded, AI credits being exhausted, invalid input, rejection of the request by the security mechanisms, a lack of internet connection on the user's side, or force majeure.

3.3. Deadline for submitting a request

A request must be submitted within 7 days of the day on which the event referred to in point 3.1 occurred.

The period runs from the day on which the AI feature was unavailable, not from the day the plan was purchased. If the unavailability lasted longer than one day, the period runs from the last day of its duration.

Our response deadline. We decide on a request without undue delay, no later than within 48 hours of receiving it. This short deadline follows from the billing model: where a request is directed to Stripe first, our failure to respond within that time entitles Stripe to refund the money on its own initiative. This deadline does not shorten the statutory fourteen-day period for handling the complaints referred to in section 4.

3.4. Amount of the refund

Monthly plan and one-off purchase for one month. The refund is calculated in proportion to the unused AI credits assigned to the current billing period.

Example: if 80% of the credits granted for a given month remained at the time of the request, 80% of the fee for that month is refundable.

Yearly plan. AI credits are granted in twelve monthly tranches, and therefore the refund covers:

  • the full fee for months that have not yet begun, and
  • part of the fee for the current month, calculated in proportion to the unused credits of that month.

Example: with a yearly plan paid in advance, a request during the third month and 80% of that month's credits unused, the refund covers the fee for the nine months not yet begun plus 80% of the fee for the third month. The first and second months, fully used, are not refundable.

3.5. Effect of a refund — loss of access

Receiving a refund means the end of paid access. From the moment the refund is executed:

  • the account returns to the free plan,
  • the AI credit pool attached to the plan is set to zero (credits purchased separately, outside the plan, remain on the account),
  • access to all features covered by the paid plan is withdrawn,
  • the subscription, if it was active, is cancelled and generates no further charges.

This also applies to a partial refund calculated proportionally in accordance with point 3.4 — a refund proportionate to unused credits is treated as the end of paid access, not as a price reduction with access retained.

User content remains untouched. Decks, flashcards, study history and files are not deleted. The limits of the free plan do, however, apply: it will not be possible to create new decks or flashcards above the limit, but existing ones remain available for browsing, studying, editing and deleting.


4. Statutory rights for lack of conformity of the service with the contract

This policy does not limit a consumer's statutory rights, in particular the rights arising from a digital service's lack of conformity with the contract provided for in the Polish Consumer Rights Act.

If the service does not conform to the contract, the user may demand that it be brought into conformity and, where this is impossible or would entail excessive costs, may make a declaration reducing the price or withdrawing from the contract, on the terms provided for by law.

Complaints are dealt with within 14 days of receipt.


5. Cancelling a subscription versus a refund

Cancelling a subscription is not a refund and does not result in the fee for the current period being returned. After cancellation, access to paid features is retained until the end of the paid period, and no further charges are made.

Cancellation is possible at any time, without giving a reason and without contacting support — in the application or in the Link account, where Stripe provides order management.

A one-off purchase does not renew automatically and there is nothing to cancel — access expires at the end of the paid period.


6. Refunds initiated by Stripe

Because the merchant of record is Stripe, Stripe may execute a refund on its own initiative within 60 days of the transaction, including without Glimsy's prior agreement, if Glimsy does not respond to Stripe's enquiry within the time set.

Point 3.5 applies to such a refund — its execution likewise means the end of paid access.


7. Chargebacks and payment disputes

Payment disputes (chargebacks) are handled by Stripe. A user raising a dispute results in the immediate withdrawal of paid access, regardless of the outcome. If the dispute is resolved in Glimsy's favour, access is restored.

Before raising a dispute we encourage you to contact support@glimsy.app — the matter can usually be resolved faster and with no consequences for the account.


8. Abuse

No refund is available where it was obtained or is being pursued in connection with conduct constituting a breach of the Terms of Use, in particular an attempt to obtain AI credits without payment, circumvention of plan limits, or deliberately triggering system errors.

Detection of such conduct may result in refusal of a refund, withdrawal of access and blocking of the account on the terms set out in the Terms of Use.
